Federal Judge Mandates Release of Abrego Garcia from Immigration Custody
A court has ordered the immediate release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without lawful basis.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge stated in her order.
The case originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. After his repatriation to the United States to face alien smuggling charges, he was held in immigration detention.
In her order, the court pointed out that the authorities lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

The legal proceedings center on disputed claims. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
